Patient Bill of Rights

At Prescriva, we believe every patient deserves transparent, respectful, and high-quality healthcare. This Patient Bill of Rights describes your rights and our obligations when you use healthcare services facilitated through our platform. All medical services are provided by licensed, independent healthcare providers through OpenLoop Health and its affiliated medical professional corporations. Blue Oak Services LLC dba Prescriva provides the technology platform and administrative support services only.
1. Weight Management Consumer Rights
As a consumer of weight management services, you are entitled to specific protections designed to ensure your safety and informed participation:
- You have the right to be informed that rapid weight loss may be associated with certain health risks, and that a healthcare provider should evaluate whether a weight management program is appropriate for you.
- You have the right to receive education about sustainable approaches to weight management, including the role of nutrition, physical activity, and behavioral changes.
- You have the right to know the expected duration of any treatment program and what outcomes may reasonably be expected.
- You have the right to a complete and clear explanation of all costs associated with your treatment before you commit to a subscription or purchase.
- You have the right to inquire about all components of your treatment plan, including medications, dosing schedules, and monitoring requirements.
2. Right to Quality Care
- You have the right to receive considerate, respectful, and quality care from all healthcare providers, regardless of your race, religion, gender, sexual orientation, national origin, disability, age, or source of payment.
- You have the right to expect the same standard of care via telehealth as you would receive in an in-person visit.
- You have the right to be treated with dignity and respect throughout your healthcare experience.
- You have the right to receive care that is guided by current medical evidence and best practices.
3. Right to Make Informed Decisions
- You have the right to receive information about your diagnosis, treatment, and prognosis in terms you can understand.
- You have the right to be informed of the risks, benefits, and alternatives of any proposed treatment, including compounded medications.
- You have the right to participate in decisions about your care and treatment plan.
- You have the right to refuse treatment to the extent permitted by law and to be informed of the consequences of that decision.
- You have the right to seek a second opinion from another qualified healthcare provider at any time.
4. Right to Know Your Provider
- You have the right to know the identity and professional qualifications of the healthcare provider who is evaluating or treating you.
- You have the right to know that all healthcare providers delivering services through our platform are licensed in the state where you receive care and are credentialed through OpenLoop Health.
- You have the right to request an in-person consultation with a healthcare provider at any time.
- You have the right to know the qualifications and credentials of any nutritionist, dietitian, or other support professional involved in your care.
5. Right to Privacy and Confidentiality
- You have the right to have your personal health information kept confidential in accordance with HIPAA and applicable state law.
- You have the right to know how your health information is used and disclosed, as described in our Notice of Privacy Practices.
- You have the right to request restrictions on the use and disclosure of your health information.
- You have the right to request confidential communications (e.g., that we contact you only at a specific email address).
6. Right to Access Your Records
- You have the right to inspect and obtain a copy of your medical records.
- You have the right to request amendments to your medical records if you believe they contain errors.
- You have the right to receive an accounting of disclosures of your health information.
7. Right to Give or Withdraw Consent
- You have the right to give informed consent before any treatment begins.
- You have the right to withdraw your consent for telehealth services at any time without affecting your right to future care, in accordance with California Business & Professions Code §2290.5.
- You have the right to a copy of your Informed Consent for Telehealth Services.
8. Right to Safe Medications
- You have the right to be informed that compounded medications are not FDA-approved or FDA-evaluated for safety, efficacy, or quality.
- You have the right to discuss the risks, benefits, and alternatives of any prescribed medication with your healthcare provider.
- You have the right to know that all medications are dispensed by state-licensed 503A compounding pharmacies in compliance with state and federal law.
- You have the right to report any adverse reactions or side effects to your healthcare provider.
- You have the right to know the name, dosage, and purpose of every medication prescribed to you, as well as potential interactions with other medications you may be taking.
9. Right to Transparent Billing
- You have the right to receive a clear, itemized explanation of all charges before committing to a subscription or purchase.
- You have the right to know the total cost of your treatment, including medication, consultation, and any ancillary fees, with no hidden charges.
- You have the right to cancel your subscription at any time, with cancellation taking effect at the end of your current billing cycle.
- You have the right to a full refund if a healthcare provider determines you are not a candidate for treatment. See our Cancellation and Refund Policy for details.
10. Right to Voice Complaints
- You have the right to voice complaints about your care or services without fear of retaliation.
- You have the right to have your complaints reviewed and addressed in a timely manner.
- You have the right to file a complaint with external regulatory bodies, including the U.S. Department of Health and Human Services Office for Civil Rights regarding privacy violations.

11. Right to Non-Discrimination
- You have the right to receive care without discrimination based on race, color, national origin, age, disability, sex, sexual orientation, gender identity, or any other characteristic protected by law.
- You have the right to not be discriminated against for exercising your privacy rights under HIPAA, CCPA, or other applicable law.
Our Commitment to You
Prescriva is committed to supporting your health journey with transparency, accessibility, and care. When you use our platform, you can expect:
- Provider-Led Care: Every treatment plan is developed and overseen by a licensed healthcare provider through our clinician network. Your provider makes all clinical decisions independently.
- All-Inclusive Pricing: All costs for medication, provider consultations, and shipping are disclosed upfront before you subscribe.
- Responsive Support: Our patient support team is available to assist you with questions about your account, billing, shipping, and general inquiries.
- Quality Pharmacy Partners: All medications are compounded and dispensed by state-licensed 503A pharmacies that meet state and federal quality standards.
Important Information and Disclaimers
To ensure you have a complete understanding of the services provided through our platform, please review the following:
- Compounded Medications: The medications available through Prescriva are compounded preparations. Compounded medications are not FDA-approved and have not been evaluated by the FDA for safety, efficacy, or quality. They are prepared by licensed compounding pharmacies based on a prescription from your healthcare provider.
- Individual Results: Weight management outcomes vary from person to person. Results depend on many factors, including adherence to treatment, diet, physical activity, and individual health conditions. Prescriva does not guarantee specific weight loss results.
- Health Assessment: Completing a health assessment on our platform does not automatically establish a doctor-patient relationship or guarantee a prescription. Each assessment is individually reviewed by a licensed healthcare provider, who determines whether treatment is clinically appropriate for you.
- Not a Substitute for Emergency Care: Prescriva services are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.
- Platform Role: Blue Oak Services LLC dba Prescriva is a management services organization (MSO). We provide technology, administrative support, and marketing services. We do not practice medicine, employ clinicians or any healthcare providers, or make clinical decisions. All medical services are provided by independent, licensed healthcare providers through OpenLoop Health.
Your Responsibilities as a Patient
Along with your rights, you also have responsibilities that contribute to your safety and the quality of your care:
- Provide accurate and complete health information during assessments and consultations
- Follow the treatment plan recommended by your healthcare provider
- Inform your provider of any changes in your health condition
- Report any adverse reactions or side effects promptly
- Keep your account information secure and up to date
- Treat healthcare providers and staff with respect
- Ask questions when you do not understand your diagnosis, treatment, or medications
- Notify us if you are receiving care from other providers or taking other medications that may interact with your treatment
